sled 4 sale

Once agian Im the luckiest guy in the world, I sold the sno pro to this kid. anyways I go and cash the check and everything is fine. the next day his dad calls me and says he wants his money back. what do you do? by the way the kid is 15 and he knew exactly what he was buying(planned to race) and the sled is in perfect shape. Anyone know the laws about this?

Ask why he wants it back.

The best thing would be to buy it back from the kid. If he didn't get parental permission from the parents, the best thing would be to ask why, and then refund the money.

I'm not too sure on the laws, but the law isn't important here. If the father of the MINOR wants the money back, give him the money.

How much did you sell the sled for?

You could tell him no, but I think it would be more trouble than it was worth. Buy it back, have him give you a $20 processing fee....

Sounds like you entered into a contract with a minor (which, of course is illegal in almost all states). Don't see that you have much choice but to refund the money.
Sorry to hear, but things happen for a reason....right buyer will come along!!

As far as I know when it comes to minors in contracts, a minor is eligible to enter a contract just like anybody else. The catch is he can disaffirm (ie back out) at any time before he turns eighteen, or a reasonable time after his eighteenth birthday. To make things easier for yourself, and avoid legal trouble, refund the guy's money but make certain the ownership of the machine goes back under your name. Contracting with minors is risky business, and that's why almost any business on the planet will not enter into contracts with minors. Get your sled back and sell it to someone over 18, it'll potentially save you a lot of grief.

I minor can by a snowmobile just like he can go and buy pepsi. If he used funds that isn't his, then he is committing fraud. Punishable to minors also. I'm not a lawyer, but since your not a retail outlet I don't think your obligated by law to ask for I.D. How are you to know that check isn't his. Sounds like your in a moral dillemma to me.

You ARE wrong U.P.!! You cannot enter into a contract with a minor!! This is much more than buying a Pepsi!! You said it yourself..........you're not a lawyer!!

its a shame you can't sell it, it looks real good. all the sno-pros around me sell in like 2 days flat, i know i tried to buy one before we bought the zl.

I called the laywer, he said that it is legal and fine to buy something if you are a minor. The only way to get his money back is to take me to cort.

Here you would be sunk. I know from first hand experience. My brother sold his truck to a 17, him being 17 also at the time. They kept getting their lawyer to call our house, trying to get us to pay up even though there was a court date already set. They called my brothers work, were he was working part time which is considered harrassment. Thats the only reason he got off. Sounds like your fine though, aslong as its legal to sell like you say. It was a stupid decision on his part, not yours. What did he say the reason is?

If you laywer said it's legal I dont see why you would have to give your money back. You should look on the check and see if its the father's name or the kid's name and whos name is under it for owning it. If it's the dads then there screwed or do I have no idea what i'm talking about like most of the time.
